Poll: Should Massachusetts Legalize Fireworks?

After last week's Independence Day celebrations, we want to know what you think about legalizing fireworks in Massachusetts.

If anyone from Wrentham wanted to enjoy fireworks during last week's Fourth of July celebrations, a drive to nearby Foxborough, Walpole, or Sharon was in order unless you happen to live bye someone who illegally shot of their own.

In support of the legalizing of fireworks are both State Senator Richard Ross and State Representative Dan Winslow. Currently, Massachusetts is only one of four states that does not allow for the sale, distribution, or use of consumer fireworks.

“It’s better to have it regulated, legalized, and taxed,” Winslow said.

Calling the law an example of a "Nanny State" and partisan vote, Winslow referenced a proposal from Rep. Bastien to legalize sparklers a week and a half ago that was defeated on party vote.

Despite it being illegal to transport fireworks from a state where they are legal, that has not stopped Massachusetts residents from driving to New Hampshire to purchase them and set them off back home. With Rhode Island legalizing fireworks in 2010, the long drive is no longer necessary with the Ocean State providing easier access for residents across southeastern Massachusetts.

Currently the penalty for using fireworks ranges from $10 - $100 with a mandatory seizing of the fireworks. The sale of fireworks can lead to a $100 - $1,000 fine and up to one year in jail.
